Terms of sale

New Window publishes and supports the products on this site, and is a trading name of New Window LLC.

Payment is not taken by New Window. Polar Software Inc. acts as the merchant of record: they are the seller on your receipt, they take the payment, they collect and remit any sales tax or VAT, and they issue your invoice. Your purchase is therefore also subject to Polar’s terms of service.

In practice that split means: questions about the product, its contents or its accuracy come to New Window LLC. Questions about payment, tax or an invoice are Polar’s, though we will help you reach them.

Every product on this site is a digital download — a set of files, listed individually on the product page before you pay, with a sample of the actual contents you can read without buying. There is no subscription, no account to maintain and nothing that expires.

You get access immediately after payment, through Polar. Nothing is shipped and nothing arrives later.

You get a perpetual, worldwide, non-exclusive licence to use the files you have bought. Under it you may:

• use the files inside your own organisation, with no limit on the number of people;
• adapt, edit and extend them, and use the result in work you deliver to your own clients — these products exist to be used that way;
• keep using them indefinitely, including after any campaign or listing ends.

You may not:

• resell, sublicense or redistribute the files substantially as they are;
• publish them anywhere they can be downloaded by people who have not bought them;
• repackage them as a competing product.

Copyright stays with New Window LLC. The licence is yours and cannot be transferred, except along with the business it was bought for.

They are templates, checklists and reference material. They are not legal, security, compliance, tax or other professional advice, and buying one does not create a professional relationship between us.

You are responsible for reviewing what you buy and adapting it to your own circumstances before you rely on it. Where a product quotes or cites a third party’s published terms, it does so as of the retrieval date shown on the product page — those documents change, and we do not undertake to track them for you after you buy.

Every product page carries a section headed “What you still have to do”. That section is part of the description, not a disclaimer bolted onto it: it is the honest account of the work the product does not do for you, and it is worth reading before you buy rather than after.

The sample, the file list, the file count and the formats shown on a product page are generated from the files you actually receive, not written by hand. If what you download does not match what the page showed you, that is a defect and we want to hear about it — it is also, plainly, grounds for a refund.

We do not promise the site or the download will be available without interruption. Downloads are hosted by Polar; if you cannot reach your files, contact us and we will get them to you.

To the fullest extent the law allows, New Window LLC’s total liability arising out of or in connection with a product is limited to the amount you paid for it, and we are not liable for indirect or consequential loss, lost profits, or loss of data.

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. If you are buying as a consumer, your statutory rights are unaffected by anything on this page.

We may change these terms. The version in force when you buy is the one that governs your purchase, and the date at the top of this page tells you when the current text was published.

These terms are governed by the laws of the State of California, United States. If you are buying as a consumer somewhere else, you keep the protections of the mandatory law of the country you live in.
